COPP Issues Decision on Complaint Against CURC

On May 13 Katherine Scholl of Florence, MT filed a campaign practices complaint against Conservatives United for Richland County (CURC) alleging that the group failed to file a required C-6 committee finance report.

On May 18 the COPP issued a decision finding that CURC failed to timely file its C-6 committee finance reports due March 30 and April 30. The group has filed the reports and is currently in compliance even though the reports were late, which is a violation.

“We are a newly formed political action committee. We had the reports filed on time but the filing was marked pending because the ‘submit button’ was not clicked on the online form,” stated CURC committee member Jordan Hall. “The complaint was filed by an advocate of the Solutions Caucus. She has filed several complaints against conservative groups. Frankly, I’m not expecting so much as a fine. All the reports are now filed with the I’s dotted and T’s crossed”

The matter has now been turned over to the County Attorney, Lewis & Clark County, for his consideration as to prosecution. If the county attorney waves the right to prosecute or fails to prosecute in 30 days, the matter returns to the COPP for prosecution. Most matters are waved back to the COPP. The Finding and Decision does not necessarily lead to civil prosecution as the Commissioner has discretion in regard to legal action.
